RESOLUTION OF THE

SEARCY REGIONAL CHAMBER OF COMMERCE

BOARD OF DIRECTORS

A RESOLUTION SUPPORTING THE CITY OF SEARCY, ARKANSAS

ESTABLISHING PROCEDURES RELATED TO APPLICATIONS FOR PRIVATE CLUB PERMITS UNDER ARKANSAS LAW; AND FOR OTHER PURPOSES

WHEREAS, During the 2017 Regular Legislative Session, the Arkansas General Assembly of the State of Arkansas adopted Act 1112 of 2017, amended Ark. Code Ann. 3-9222 providing that an application for a private club and the sale of alcoholic beverages must originate in the municipality in which the private club wishes to undertake operations; and

            WHEREAS, the Searcy Regional Chamber of Commerce wishes to renew and restate their position that the body feels it is in the socioeconomic best interests of the City of Searcy to continue the practice of issuing permits to serve alcohol by the glass to applicants who meet the criteria deemed appropriate by the State of Arkansas; and

WHEREAS, the Chamber believes the appropriate manner for assessing applications should be derived from consideration of the various criteria established by, and in use by various other municipalities where the practice has been in use for a period of several years, and which seem to be thriving economically under their current system; and

            WHEREAS, the Chamber agrees that an appropriate, reasonable set of requirements for qualification should be debated and ultimately adopted with the goal being to err on the side of issuing rather than denying appropriate applications; and

            WHEREAS, the Chamber feels that the Council should not establish a set of requirements that serves to significantly inhibit the issuance of said permits, such as the establishment of footage requirements from places such as schools and churches, which the Chamber feels apply more appropriately when permits for liquor stores are being issued, and not restaurants who derive the majority of their revenues from the sale of food items; and

            WHEREAS, the Chamber feels that establishing footage requirements from various types of sites would significantly inhibit appropriate/strategic restaurant placement in a town the size of Searcy, and ultimately make said market less attractive to restaurants seeking to expand to our market; and

THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SEARCY REGIONAL CHAMBER OF COMMERCE:

That the Chamber restates its position endorsing the issuance of permits for the sale of alcohol by the glass to appropriate applicants and encourages the City Council to adopt an ordinance similar to those in use by Arkansas towns who have successfully implemented these changes, said ordnance being no more restrictive than those rules used by the State of Arkansas in such proceedings. The Chamber feels strongly that City of Searcy deserves to have every economic advantage afforded our surrounding communities, and issuance of said permits is necessary to enable Searcy to compete admirably with those communities for businesses, restaurants and other industry. We do hereby support an ordinance for Private Clubs to Encourage Job Creation, Job Expansion, and Economic Development.
